Legislative Update: State budget, ERS overtime calculation and pension tax

Thursday, March 24, 2011 was Second Lateral – all bills with more than one committee referral must be in the final committee, otherwise they will be considered “dead.” With the exception of the Collective Bargaining Vehicle bills (deferred indefinitely in House Labor) and the Exempt to Civil Service Conversion bill (Union and Employer mutually agreed to resolve issues outside of legislation), our priority bills are still alive and moving.

Priority Bills Update

State Budget (HB200, HD1): will be heard by Senate Ways and Means (WAM) on March 28, 2011.

Takeaway Bills

ERS Overtime Calculation (SB1269, SD2, HD1): pending hearing in House Finance (FIN)

  • House Labor amended the bill by differentiating between mandatory and voluntary overtime

Pension Tax (HB1092, HD1, SD1): pending hearing in Senate WAM

  • Senate Judiciary and Labor (JDL) expanded the taxable base and reduced the federal adjusted gross income thresholds to $75,000 for single, $112,500 for head of household, $150,000 for joint filers
